What a valid notice must contain

To be effective under 17 U.S.C. 512(c)(3), a written notification must include substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works at this site are covered by a single notification.
  3. Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to let us locate it — a direct URL is best.
  4. Information reasonably sufficient to let us contact you: address, telephone number and, if available, an email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

A notice missing any of these elements may not be actionable, and we will write back asking for what is missing.

What we do when a notice arrives

We acknowledge receipt inside 1 business day. Where the notice is complete, we remove or disable access to the identified material promptly and notify whoever supplied it. Where it is not, we say what is needed.

Counter-notification

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notification under 17 U.S.C. 512(g)(3) containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good faith belief it was removed as a result of mistake or misidentification, your name, address and telephone number, and your consent to the jurisdiction of the federal district court for the district where you live — or, if outside the United States, for any district in which we may be found — and that you will accept service of process from the complaining party.

We forward a valid counter-notification to the original complainant. If they do not file a court action seeking to restrain the material within 10 to 14 business days, we may restore it.

Misrepresentation

Under 17 U.S.C. 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages including costs and legal fees. Please be sure before you send.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of anyone who repeatedly infringes copyright.

Trademarks

Trademark complaints are not covered by the DMCA. Send those to info@mirovelstudio.shop with the subject line Trademark Complaint, identifying the mark, its registration details and the material you object to.
